How Mississippi got here
Mississippi added nitrogen hypoxia to its statutory list of authorized execution methods in 2017 as a fallback if lethal injection becomes unavailable or is held unconstitutional. The Mississippi Department of Corrections has never published a nitrogen protocol and has not sought a warrant citing the method. Post-Lee, Mississippi legislators have indicated no appetite to move first.
